Terms of Service

NexusBids provides a cloud-based bid management platform designed for general contractors and construction estimators. You may use the Service only for lawful purposes and in accordance with these Terms.

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the organization you represent.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@nexusbids.com if you suspect any unauthorized use.

You are responsible for ensuring all users within your company workspace comply with these Terms.

You agree not to use the Service to:

• Upload or transmit any data that is unlawful, harmful, or infringes on intellectual property rights
• Attempt to gain unauthorized access to the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the platform
• Use automated tools to scrape or extract data without our written consent
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service for spam, phishing, or any fraudulent activity
• Interfere with or disrupt the integrity or performance of the Service

Access to certain features requires a paid subscription. Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). All fees are non-refundable except as required by law.

We reserve the right to change subscription pricing with at least 30 days' notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

If payment fails, we may suspend access to the Service until payment is resolved.

You retain full ownership of all data, content, and information you upload or create within the Service. By using the Service, you grant NexusBids a limited, non-exclusive license to store, process, and display your data solely for the purpose of providing the Service.

We do not sell or share your data with third parties for their commercial purposes.

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, upgrades, or circumstances beyond our control.

You may cancel your account at any time through account settings or by contacting support. Upon cancellation, your access continues through the end of your current billing period.

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms or engage in fraudulent activity.

Upon termination, we will retain your data for 90 days, during which you may request an export. After that period, your data will be deleted.

The NexusBids platform, including its design, software, features, and branding, is owned by NexusBids and protected by intellectual property laws. You may not copy, modify, or create derivative works from any part of the Service without our written permission.

To the maximum extent permitted by applicable law, NexusBids shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Our total liability to you shall not exceed the greater of (a) amounts you paid us in the 12 months preceding the claim, or (b) $100 USD.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free or uninterrupted.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will notify you of material changes when possible. Continued use after changes become effective constitutes acceptance of the new Terms.

These Terms shall be governed by the laws of the State of Texas, United States. Disputes shall be subject to the exclusive jurisdiction of courts located in Texas.
